BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS CONTAINED.

1. Term of Agreement

This Agreement shall be for an "Initial Term" as chosen by you at the time you register for the Services. This Agreement will be automatically renewed at the end of the Initial Term for the same period as the Initial Term unless you provide webdesignserver.com with notice of termination thirty (30) days prior to the end of the Initial Term or the Renewal Term.

2. Termination Policy

If you terminate the Services prior to the end of the Initial Term or the Renewal Term, whichever is then applicable:

•  webdesignserver.com will not refund to you any fees paid in advance of such termination and you shall be required to pay 100% of webdesignserver.com standard monthly charge for each month remaining in the term.

If webdesignserver.com terminates the Services prior to the end of the Initial Term or the Renewal Term, whichever is then applicable:

•  If webdesignserver.com terminates this Agreement, webdesignserver.com will refund to you the pro-rata portion of prepaid fees attributable to Services not yet rendered as of the termination.

• If termination was enforced to due violations that result in damages or fees assigned to webdesignserver.com on your behalf, no refunds shall apply and you will be held liable for such fees.

3. Bandwidth

You agree that use of the Services under this Agreement will not exceed the bandwidth and storage usage limits set out.

If you use any bandwidth or storage space in excess of the agreed upon number of megabytes per month, you agree to pay the associated additional charges.

4. Storage Usage

webdesignserver.com is in no way responsible for the client's data and or the backup of that data.

Data stored in your user account on a webdesignserver.com server is not owned by webdesignserver.com ; therefore Data preservation is the ultimate responsibility of the client.

The Customer is responsible for keeping a copy of their most current data and files as backup on a remote system. webdesignserver.com is not responsible for any lost files, information, or data. webdesignserver.com does not guarantee to possess the most current copy of a Customer's data or files.

5. Content

You may not use your web space to provide material, or links to material, that is offensive to the Web community or is illegal. This includes but is not limited to:

•  Expressions of bigotry, racism, hatred, or profanity;
•  Promotion or display of instructional information supporting illegal activities;
•  Propagation of "spam" email and/or computer viruses;
•  Promotion of physical harm or injury against any group or individual;
•  Adult Content;
•  Pirated software and Hacker programs;
•  Copyright violation of of data and files for which the Customer does not have     appropriate authorisation for;

The subscriber agrees to indemnify and hold webdesignserver.com harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

6. Computer Resources

Any abuse of our systems is not allowed including but not limited to use of excessive CPU resources, use of excessive disk space, use of excessive e-mail storage space, hacking our systems or any other activity which may compromise the useability or security of webdesignserver.com systems.

7. Domain names

webdesignserver.com will acquire an Internet Domain Name on behalf of the Customer, as specified. 

webdesignserver.com does not warranty that it's registration services are successful. 

Under no circumstances will webdesignserver.com be held reliable for losses or damages suffered by Customer resulting from delays in the registration process or failure to acquire such said intellectual property.

8. Functionality

The functionality of webdesignserver.com depends on coöperation, services and suppliers on which we have little or no influence. Therefore we can not accept responsiblity for any damages or losses cause by non- or improper functionality.

9. Prices

webdesignserver.com reserves the right to change prices at any time, and will endeavour to provide reasonable notice of any such changes.

10. Payments

All charges for Services must be paid in advance according to the then current prices applicable to the Services.

Payments can be done by transfering the amount to our bancaccount. We encourage you to pay by recurring direct bank transfer which may be set up at your bank.

Your failure to fully pay any fees within five (5) days after the applicable due date will be deemed a material breach of this Agreement, and webdesignserver.com may delete any and all content from the webdesignserver.com servers.

Any such suspension or termination of the Services would not relieve you from paying past due fees.
